Yet Another True Story About Stupid Studies:

Amen, yer honor!

The lawsuit launched by Fox and News Corp. came to a fair and balanced screaching halt on Friday, when a federal judge lambasted the plaintiff's attorneys. Fox had attempted to prevent the publication of Franken's Lies and the Lying Liars Who Tell Them: A Fair and Balanced Look at the Right.

There are hard cases and there are easy cases. This is an easy case," said U.S. District Judge Denny Chin, who added, in a fair and balanced opinion, that the motion for an injunction was "wholly without merit." He said it is highly unlikely that consumers would be misled to think that Fox is sponsoring the book. He also said the trademark is "weak."

While "strong" and "weak" are trademark law terms of art, nonetheless, calling Fox's alleged trademark "weak" is kind of like calling Iraq's chances of hosting the next summer Olympics "doubtful." Good lord, this is really quite something. There have been several fair and balanced legal decisions this year that actually follow the conventional wisdom!
