Next up, the little bastards at MySpace...

Having suffered the slings and arrows of Google's ranking algorithms myself, I feel for KinderStart, but suing for defamation is a tad extreme:

SAN JOSE, California (Reuters) - A federal judge on Friday questioned whether Google Inc. defamed a small company by [suddenly moving it from appearing high on the results page to much farther down or off entirely]...

Judge Jeremy Fogel of the U.S. District Court for the Northern District of California heard arguments in a lawsuit by KinderStart.com LLC that seeks to challenge the fairness of how Google calculates the relative popularity of Web sites.

Said plaintiff's counsel, Gregory Yu,

The fact that they (Google) have used a computer shouldn't affect whether it is defamatory.

Next on the docket for attorney Yu is a massive two-pronged attack on MySpace, in XOlittledemonOX v. CruznSuzn, et. al.

In the first count of that complaint, Yu seeks a determination as to whether Tom is entitled to be everyone's friend, "...just because he owns the thing." The second count has a whopping 28 defendants. Yu seeks damages from so-called friends who have moved XOLittleDemonOX from their top 8 spots and thus relegating him to page two, which, according to Yu's complaint, "...is for losers and freaks."

Attorneys involved in the O'Callaghan v. 16 AIM Users case could not be reached for comment. They have prosecuted an analogous case, involving the method of determining the order in which BFFLs are listed in away messages.
